We (the team at Webventure Avenue, Inc.) are on a mission to help you discover and find the perfect songs for any moment with I Need This Song Right Now. We hope you love our service — connecting you with the music you need when you need it — as much as we love creating it.
These Terms of Service (“Terms”) describe our commitments to you, and your rights and responsibilities when using our service. Please read them carefully and reach out to us if you have any questions. If you don’t agree to these Terms, don’t use our service.
Terms of Service
These Terms govern your access to and use of the I Need This Song Right Now website at ineedthissongrightnow.com and the I Need This Song Right Now iOS app (our “Service”).
By accessing or using any part of our Service, you agree to be bound by all of the Terms and all other operating rules, policies, and procedures that we may publish via the Service from time to time (collectively, the “Agreement”).
1. Who’s Who
“You” means any individual using our Service. If you use our Service on behalf of another person or entity, you represent and warrant that you’re authorized to accept the Agreement on that person’s or entity’s behalf.
“We,” “us,” and “our” refer to Webventure Avenue, Inc., and its operators.
2. Your Account and Use of Our Service
When using our Service requires an account, you agree to provide us with complete and accurate information and to keep the information current. We may need to send you emails about notable updates (like changes to our Terms of Service or Privacy Policy).
You’re solely responsible and liable for your use of our Service and all activity under your account. You’re also fully responsible for maintaining the security of your account and keeping your password secure.
Don’t share or misuse your access credentials. Notify us immediately of any unauthorized uses of your account or any other breach of security.
3. Minimum Age Requirements
Our Service is not directed to children. You’re not allowed to access or use our Service if you’re under the age of 13. If you register as a user, you represent that you’re at least 13. You may use our Service only if you can legally form a binding contract with us. If you’re under 18 years of age, you can only use our Service under the supervision of a parent or legal guardian who agrees to the Agreement.
4. Responsibility of Users
We haven’t reviewed, and can’t review, all of the content (like playlists, song recommendations, reviews, comments, and other materials) posted to or made available through our Service by users (“Content”). We’re not responsible for any use or effects of Content. So, for example:
- We don’t endorse any Content or represent that Content is accurate, useful, or not harmful
- You’re fully responsible for any Content you submit to our Service
- Content could include technical inaccuracies, typographical mistakes, or other errors
- You’re responsible for taking necessary precautions to protect yourself and your devices from harmful content
5. Music and Copyright
Our Service helps you discover music and may provide links to music streaming services, music stores, or other platforms where you can legally access songs. We do not host, store, or provide copyrighted music files. All music discovery and access must comply with applicable copyright laws and the terms of service of music platforms you choose to use.
6. Fees and Payment
Basic Service
Our basic music discovery service is free to use.
Premium Features
We may offer premium features for a fee (“Premium Service”). By using Premium Service, you agree to pay the specified fees. Premium subscriptions will automatically renew unless you cancel.
Payment: You must provide accurate and up-to-date payment information. If payment fails, we may immediately cancel your access to Premium Service.
Automatic Renewal: Premium subscriptions automatically renew and we’ll charge your payment method unless you cancel at least 24 hours before the end of the subscription period.
Refunds: We may provide refunds if required by law. In all other cases, there are no refunds and all payments are final.
7. Feedback
We love hearing from you about music discoveries and ways to improve our Service. When you share comments, ideas, or feedback with us, you agree that we’re free to use them without any restriction or compensation to you.
8. General Representation and Warranty
You represent and warrant that your use of our Service:
- Will be in strict accordance with the Agreement
- Will comply with all applicable laws and regulations
- Will not be for any unlawful purposes or to publish illegal content
- Will not infringe or misappropriate the intellectual property rights of any third party
- Will not overburden or interfere with our systems
- Will not disclose the personal information of others
- Will not interfere with, disrupt, or attack any service or network
- Will not involve reverse engineering, decompiling, or disassembling our Service
9. iOS App Specific Terms
Our iOS app is designed to work seamlessly across Apple’s iOS, macOS, and VisionOS platforms. The app may use CloudKit for data synchronization across your devices.
Your use of our iOS app is also subject to Apple’s App Store Terms of Service. If you download our app through the App Store, Apple’s terms apply to that download and use.
10. Third-Party Services
Our Service may integrate with third-party music services, streaming platforms, or social media services. If you use any third-party services through our Service:
- Third-party services aren’t controlled by us
- Any use of third-party services is at your own risk
- Third-party services may have their own terms and privacy policies
- We’re not responsible for third-party services or their content
By using our app and making in-app purchases, you consent to our sharing of data regarding your usage and consumption of purchased content with Apple, as part of our efforts to resolve refund requests. This information may include details about how you have accessed and interacted with the purchased content. The purpose of sharing this data is to help Apple make an informed decision regarding refund requests. We ensure that such data sharing is done in compliance with Apple’s policies and only as necessary to process your requests.
11. Copyright Policy
We respect the intellectual property rights of others. If you believe any Content violates your copyright, please contact us with details of the alleged infringement.
12. Intellectual Property
The Agreement doesn’t transfer any intellectual property to you. “I Need This Song Right Now” and all related trademarks, service marks, graphics, and logos are our property. Using our Service doesn’t grant you any right to reproduce or use our trademarks.
13. Changes
We may modify these Terms from time to time. If we do, we’ll provide notice of the changes by posting the amended Terms and updating the “Last Updated” date. If changes are material, we may notify you through our Service or other communications. By continuing to use our Service after we’ve notified you, you agree to be bound by the new Terms.
14. Termination
We may terminate your access to our Service at any time, with or without cause, including if we believe you have violated this Agreement. You can stop using our Service at any time, or cancel your Premium subscription subject to the payment terms above.
15. Disclaimers
Our Service is provided “as is.” We disclaim all warranties to the maximum extent allowed by applicable law, including warranties of merchantability, fitness for a particular purpose, and non-infringement. We don’t warrant that our Service will be error-free or continuously available.
16. Jurisdiction and Applicable Law
The Agreement will be governed by the laws of Illinois in the United States of America, and the proper venue for any disputes will be the courts located in Wheaton, Illinois.
17. Limitation of Liability
We will not be liable for any special, incidental, or consequential damages, or for any amounts that exceed $50 or the fees paid by you during the twelve (12) month period prior to the cause of action, whichever is greater.

19. Miscellaneous
This Agreement constitutes the entire agreement between us concerning our Service. If any part is unenforceable, that part is severable and doesn’t affect the rest of the Agreement.
